Adult Content Creator Network - By-Laws

Section 1 - Membership requirements:

Members of the ACCN at any level must be at least 18 years old.

  1. The ACCN is an international organization and board members may be citizens of any nation. Membership may be granted to people of any nation.
  2. Membership may not granted to people who are members of organizations whose goals are contrary to the ACCN.
  3. Membership may not be granted to people who produce, spread, or promote any media whose creation intentionally involved any acts of demonstrable harm to any real-world humans and/or animals.

Section 2 - Privacy:

  1. Legal names of Board Members may be required to be present on certain official documents such as protocols, but board members are allowed to present themselves under pseudonyms during actual organization proceedings. Board members choosing to present themselves under pseudonyms during proceedings acknowledge that when these proceedings are concluded, the president is empowered to replace the pseudonyms with the respective legal names on official documents.
  2. Legal names may only be requested by the acting president or the secretary through private means between the president/secretary and other members individually. Private means may be through direct messages or email, and it is up to the person sharing their name which channel is used. No member is empowered regardless of rank in the organization to demand personal information, but certain information is required for continued membership of the board. Failure to comply may result in expulsion from the board.
  3. Official documents containing legal names and private information such as protocols and voting registries shall not be made public as long as they contain legal names and sensitive personal information.
  4. Any and all By-laws may be subject to change from the Board. Changes to by-laws may only be enacted through democratic means by the Board, though any vote which would be covered by By-law 4.3 cannot take effect until the requirements of By-law 4.3 have been met; nor can any vote change By-law 4.3 without unanimous consent of the Board.
  5. In the event of any changes to the by-laws affecting any personal and/or legal information, any board member or member who has previously provided such information has the right to have all their personal and/or legal information removed from all previous records and official documents where possible.
  6. When a member's association with the ACCN ceases, all of their legal information they wish to be removed from all internal and/or public records shall be removed where possible, except where required by law.
    1. If no wishes are communicated by the ex-member, the assumption will be removal of all information.
  7. Copies of official documents may be made publicly available as long as legal names have been replaced by pseudonyms and sensitive personal information (age, personal identification numbers, addresses et al) has been removed.
  8. Any member of the board reserves the right to object to making a public copy of any official document as well as reserving the right to call for a vote against making a public copy of an official document.
  9. Official documents containing legal names and personal information may be shared to legal authorities and agencies as required by law.
  10. In compliance with the General Data Protection Regulation (GDPR), all EU citizens that make up membership of the organization at any level must be informed of their rights to protect their personal information during any and all organization proceedings. As a general courtesy, this right is extended to members without EU citizenship.

Section 3 - Board Membership Requirements:

Includes all of the standard membership requirements from Section 1.

  1. Board membership may be prioritized by factors such as diversity or ability.
  2. All board members must fill out a written application which can be found on the Discord server, and then present themselves at a meeting. Following the meeting, the current board will vote on whether or not to accept the application, ruling by simple majority. If accepted, the individual will be formally inducted into the board at the next meeting.
  3. A written application includes:
    1. The applicant's online alias.
    2. A brief description of the applicant's relevant experience, professional or recreational. "Relevant experience" is defined as relevant to the ACCN's purpose, ideals and goals but shall be up to the applicant's discretion as to protect their identity.
    3. Brief summary of the applicant's background with Adult Content.
    4. The applicant's goals in being a board member.
  4. Board members are not allowed to state their membership status as board members on any Social Media Biography Descriptions.

Section 4 - Board Conduct:

  1. Any vote, whether it be to decide a board member or a new by-law etc. shall require a simple majority to pass.
  2. For any democratic procedure during board meetings, each board member has one vote of equal power to use. No role or individual may be provided with excessive voting power.
    1. Any result of a vote taken by the Board is only valid if the following criteria have been met:
      1. The vote is held during an official Board Meeting (requiring at least 65% of the total Board membership's presence.)
      2. The vote ends with a simple majority of over 50% of the total Board Membership voting in favor.
  3. Every board member has the right to suggest new by-laws(or to suggest the removal or editing of current by-laws) which shall be voted upon during board meetings.
    1. For a new By-Law to be put into effect:
      1. The Law must be presented in written form in a mean that all current Board Members may reasonably access.
      2. Secondly, they must present it during a board meeting, where the merits of said law may be discussed.
      3. After the proposed law has been presented, board members will have until the next board meeting(minimum of one week) to vote on its acceptance.
      4. At the next board meeting, the by-law will be accepted or rejected in respect to the results of the vote.
  4. Board meetings may be open to all ACCN members to listen and join in the chat. By default, only board members may have voice chat permission, but they may allow other members to speak at their discretion.
  5. Board members are expected, but not required, to participate in every board meeting with the exception of the yearly board meeting which all board members are required to participate in, with exceptions for:
    1. Health-related reasons.
    2. Urgent family matters.
    3. Matters that are by all means unpredictable.
    4. Personal reasons that the board is informed of with at least 60 days of notice.
  6. Board members may be expelled from the board if the majority of the board considers it necessary for the continued health and purpose of the ACCN. For any board member to be expelled from the board, the cause for such an expulsion must be presented during a board meeting and/or ahead of one and a vote must be called during a board meeting (non-present members may leave their vote in the Discord server). A vote for expulsion must pass a minimum of 90% (rounded up) votes in favor, abstained votes do not count towards the total. Grounds for expulsion from the board include:
    1. Significant lack of participation in board meetings or group activities.
    2. Failure to perform tasks volunteered for.
    3. Repeated failure to communicate with other board members of the ACCN.
    4. Acting against the purpose of the ACCN in public or in private.
    5. Hostile behavior towards ACCN members, or public hostility towards non-members with a pronounced association with the ACCN. E.G: "As a member of the ACCN I wish ill on another person."
    6. Claiming to speak for the ACCN without board approval.
  7. In emergency situations regarding Board Member conduct that may be grounds for expulsion, Board Members may call for an immediate suspension of the Board Member in question that places said Board Member on read-only mode until a vote can be called for that Board Member's expulsion.
    1. The decision to suspend a Board Member requires the review and approval of at least one moderator and the acting president of the Board.
  8. The roles of president and vice president are to be elected once a year. There is no limit to the number of consecutive terms a president or vice president may serve.
    1. An emergency election is to be held as soon as possible in the event that a president or vice president is unable to perform their duties, such as in the case of expulsion, significant injury, long-lasting illness, etc.
  9. The role of president is to oversee the organization's activities and to maintain order during board meetings as well as officialize any decisions made by the board. In the event that the president cannot fulfill their duties, the powers and responsibilities are transferred to the vice president until the president has returned.
  10. The roles of President and Vice-President are not immune to removal, which may be enacted by the above process (Section 4.6).
  11. The role of secretary must be officially assigned to one member of the board, but during board meetings, any board member may volunteer or be assigned the role of secretary in the event that the official secretary cannot be present.
  12. The acting President is empowered as the only required signatory for any official documents or applications.
  13. All strategies, campaigns and Projects associated with the ACCN must be officially defined, approved and declared by the Board.
  14. The Board's mandatory Yearly Meeting is to be held in January, on a specific date that must be set by the Board at least 60 days before the Yearly Meeting.

Section 5 - Membership Conduct:

  1. The ACCN recognizes two tiers of membership.
    1. Board Member
      1. A member of the board, responsible for both starting projects, and directing the organization.
        1. "Project Overseer" is a sub-position that may be assigned to a Board Member, and defines someone in charge of a particular ACCN Project. A Project Overseer may go about recruiting Official Members to assist in these projects.
    2. Official Member
      1. One who has filled out the Statistics Form and agreed to allow the ACCN to speak on their behalf. Official members are eligible to volunteer to assist in Projects undertaken by the ACCN.
      2. "Project Member" is a sub-role that Official Members are assigned when they join a Project Team to assist with a specific Project.
        1. A "Project Lead" is a sub-role that defines a leadership position in reference for a specific Project. It may be held by a Board Member or an Official Member.
  2. Each tier of membership comes with different levels of expected conduct.
    1. All Members.
      1. All members are expected to treat each other with respect and consideration.
      2. All members must follow the Terms of Service of whatever platform we are using in any activity.
      3. No member may harass another.
      4. While Adult Content does often address controversial subjects such as hate speech, discrimination, or other taboo topics, and we do encourage our members to discuss these subjects as they will, hate speech directed as another member is not tolerated.
    2. Official Members
      1. Official Members are expected, but not required, to participate in organization campaigns and activities.
      2. Official Members are expected to comport themselves in a manner that paints the ACCN in a positive light when performing duties related to the ACCN.
        1. Project Members are expected to be punctual, communicative, and responsible when carrying out projects for the ACCN. If you can no longer perform a duty you volunteered for, let your Project Lead know so we can adjust.
      3. Membership may be revoked on the following grounds:
        1. Being a member of organizations whose goals are contrary to the ACCN.
        2. Committing any acts, legal or otherwise, that cause harm to the ACCN.
        3. Hostile behavior towards other ACCN members.
        4. Hostile, antagonistic and/or discriminatory behavior in public that is also made expressly associated with the ACCN by the acting member, E.G: making public statements in the style of "As a member of the ACCN, I wish ill on another person."
    3. Board Members
      1. In addition to the expected conduct of Official and Server members, Board members must comport themselves in accordance with Section 4.

Section 6 - Communications

  1. All people participating in the ACCN's communication channels, such as the Discord Server or other channels, must follow the by-laws where applicable, regardless of their membership status.
